Hawkins Lead Counsel Addresses NH Bar Foundation Annual Dinner
NHLA Litigation Director Kay E. Drought gave a presentation on the Hawkins v. Commissioner dental care for New Hampshire children on Medicaid case at the NH Bar Foundation Annual Dinner May 11, 2006. Drought noted that childhood dental disease is more common than asthma or hay fever, and is almost entirely preventable if children receive regular dental care. She described how after NHLA brought the Hawkins class action, the federal district court in January 2004 approved a proposed class action settlement, a court order called a Consent Decree, reforming the Medicaid dental program for children in New Hampshire. Drought reviewed NHLA's current monitoring of the state's compliance with the Consent Decree. The Decree makes sure that children on Medicaid receive the dental care to which they are legally entitled under federal law: regular dental checkups every six months, preventative care like dental sealants and fluoride treatments, and necessary corrective dental care.
